Terms of Service

Entity: Hashlog Solutions Private Limited ("Hashlog", "We", "Us", "Our")
This Terms of Service ("Agreement") governs your use of Hashlog's software platforms — HashTMS (Transport Management System), ZingTrak (Fleet Tracking & Telematics), mobile applications, IoT/tracking devices, APIs, and related services collectively referred to as the "Services."
By signing up, accessing, or using our Services, you agree to this Agreement.
1. Definitions
- "Customer" / "You" — the business or individual subscribing to or using the Services.
- "Users" — employees or agents authorized by the Customer.
- "Devices" — GPS/telemetry hardware installed in vehicles for fleet tracking.
- "Subscription Plan" — the selected paid plan for HashTMS or ZingTrak.
- "Data" — operational, fleet, tracking, and business data that you upload or generate via the Services.
2. Account Creation
You agree to:
- Provide accurate registration details.
- Ensure only authorized Users access the Services.
- Maintain confidentiality of login credentials.
You are responsible for all activities under your account.
3. License to Use the Services
Hashlog grants you a limited, non-exclusive, non-transferable license to use the Services strictly as per your Subscription.
You may not:
- Copy, modify, or reverse-engineer the software.
- Rent, lease, sublicense, or resell access.
- Use the software to build a competing product.
4. Subscription, Fees & Payment
- Services are billed monthly or annually as per the Subscription Plan.
- Fees for hardware (if applicable), SIM/data charges, installation, and maintenance may be separate.
- Payments are non-refundable except where required by law.
- Hashlog may update prices with prior notice.
Failure to pay may result in suspension or termination of service.
5. Hardware Devices (For ZingTrak)
If your plan includes GPS/telemetry devices:
- Devices remain the property of the Customer unless purchased outright.
- The Customer is responsible for installation, care, and return if required.
- Hashlog is not responsible for performance degradation caused by mobile network issues, physical damage, tampering, or misuse.
6. Data Ownership & Privacy
- You own the data you generate using the Services.
- Hashlog may process data solely to deliver service functionality, diagnostics, analytics, fraud prevention, and improvement.
- Hashlog will not sell your data to third parties.
- Data will be stored and processed according to applicable laws and our Privacy Policy.
7. Service Availability
We strive for high system uptime but do not guarantee uninterrupted usage due to factors such as:
- Internet connectivity
- Telecom network issues
- Server maintenance
- Third-party service failures
- Vehicle/device malfunction
Any guaranteed uptime would be governed by a separate SLA (if applicable).
8. Support
Support is offered via email, WhatsApp, or phone depending on your Subscription Plan.
Support does not include custom feature development unless agreed separately.
9. Restrictions
You agree not to:
- Use the Services for unlawful transport operations.
- Track vehicles/persons without proper consent or legal basis.
- Attempt to hack, disrupt, or overload the Services.
- Upload harmful or illegal content.
10. Confidentiality
Both parties agree to protect each other's confidential information and use it only for the purposes defined in this Agreement.
11. Intellectual Property Rights
All software, code, dashboards, algorithms, designs, and documentation belong exclusively to Hashlog Solutions Private Limited.
No rights are transferred to you except the right to use the Services under this Agreement.
12. Warranties & Disclaimers
Services and devices are provided "as is".
Hashlog does not warrant:
- Exact accuracy of GPS or telematics data
- Error-free or uninterrupted service
- Compatibility with all devices or systems
Fleet tracking accuracy depends on network, hardware condition, and environmental factors.
13. Limitation of Liability
To the maximum extent permitted by law:
- Hashlog's liability is limited to the total subscription fees paid in the last 12 months.
- We are not liable for indirect, incidental, punitive, or consequential damages such as loss of revenue, business disruption, or operational delays.
14. Termination
Either party may terminate for material breach if not cured within 30 days of written notice.
Upon termination:
- Your access to the Services will be revoked.
- Outstanding fees become immediately payable.
- You must uninstall and discontinue use of all software.
If devices were provided on rental, they must be returned in working condition.
15. Governing Law & Jurisdiction
This Agreement is governed by the laws of India.
Any disputes shall be resolved in the courts of Chennai, India.
16. Changes to These Terms
Hashlog may update this Agreement from time to time.
Continued use after changes indicates acceptance.
